General provisions
These terms set out the rules for the electronic provision of services by Gazele z Iranu Bartosz Kapica, ul. Tartaczna 8, 43-178 Ornontowice, Poland, tax number (NIP) 6351786294, statistical number (REGON) 242958320.

These terms are issued under Art. 8(1)(1) of the Polish Act of 18 July 2002 on the provision of services by electronic means. They are made available free of charge, before the contract is concluded, in a form allowing them to be downloaded, reproduced and stored.
The service described below is intermediation in obtaining an Iranian visa code only.
The rules for using the website itself — including copyright in photographs and content, technical requirements and complaints about how the pages work — are set out in the Website terms. On matters concerning the visa service, these terms prevail.
Definitions
- Provider — Gazele z Iranu Bartosz Kapica.
- Client — a natural or legal person, or an organisational unit, submitting an application through the Form.
- Consumer — a Client who is a natural person entering into a contract not directly connected with their business or professional activity. The provisions concerning Consumers also apply to a natural person entering into a contract directly connected with their business activity where the contract is not of a professional nature for that person (Art. 3855 of the Polish Civil Code).
- Visa code (visa authorisation, grant notice) — a number issued by the Iranian visa authorities after vetting the applicant, on the basis of which a visa is issued. A visa code is not a visa.
- Form — the interactive application form available on the Website.
- Website — the pages in the gazeleziranu.com domain.
Type and scope of services
The Provider supplies the following services by electronic means:
- Making the Form available — free of charge. This covers filling in the application, automatic validation of the fields and a preliminary quality check of the photograph and passport scan, carried out inside the Client's browser.
- Intermediation in obtaining a visa code — for a fee. This covers checking that the application is complete, preparing it in line with Iranian requirements, filing it with the Iranian visa authorities, monitoring the case and passing the visa code to the Client.
- Browsing the Website content — free of charge.
The intermediation service is an obligation of due diligence, not of result — the decision to issue a code rests solely with the Iranian authorities and nobody can guarantee it. The Provider does undertake, however, that in the event of a refusal it will refund the whole fee for the visa code service — on the terms described in Guarantee: a visa code or your money back.
Which applications we accept
The service covers tourist visas with a single entry only. An application must meet the conditions below — the form checks them automatically and will not let you submit a request that fails them:
- a stay of no more than 30 days, counted from the entry date to the departure date — a longer stay requires a different type of visa, which we do not handle;
- a passport valid for at least 6 months from the planned return date, with at least 2 blank pages;
- single entry — we do not act as intermediary for multiple-entry visas;
- an entry date within the limits set out under Performance and deadlines.
These conditions follow from the requirements of the Iranian visa authorities, not from our decision. Failing them means the application would be rejected by those authorities — which is why we block it on our side before the Client pays.
Technical requirements
To use the Form you need:
- a device with internet access,
- an up-to-date web browser (Chrome, Firefox, Safari, Edge) with JavaScript enabled,
- a working e-mail address,
- a photograph of your face and a scan or photo of your passport data page, in JPG or PNG format.
The Form stores a draft of the application in the open browser tab so that what you have typed is not lost when the page reloads. The draft does not include the photograph or the passport scan and disappears when the tab is closed.
The Provider is not liable for an inability to use the Form arising from causes on the Client's side, in particular lack of internet access, JavaScript being disabled, or the use of a browser no longer maintained by its manufacturer.
Risks typical of electronic services (Art. 6(1) of the Act on the provision of services by electronic means): malicious software, attempts to obtain data by deception (phishing) and interception of transmissions. The Provider uses an encrypted HTTPS connection and transmits the photograph and passport scan only in an archive encrypted with AES-256. We recommend using up-to-date antivirus software and not sending documents over unsecured public networks.
Conclusion of the contract
The button that completes the form is labelled „Order with obligation to pay". The amount due and the processing mode chosen are shown immediately above it. Clicking that button places an order that carries an obligation to pay — this is required by Art. 17(3) of the Polish Act of 30 May 2014 on consumer rights.
- Completing and submitting the Form constitutes an offer to conclude a contract for intermediation in obtaining a visa code.
- The contract is concluded when the Provider confirms acceptance of the application by e-mail to the address given in the Form.
- The Provider may refuse to accept an application, in particular where it is incomplete, or the documents do not meet the requirements despite a request to correct them. The Client is informed without delay and, if payment has already been made, receives a full refund.
- The contract covers one person. A separate application is submitted for each traveller.
- The Client may cancel the service before it begins by notifying the Provider at wiza@gazeleziranu.com.
Price and payment
- The price depends on the processing mode chosen (normal or rapid) and is shown in the Form before the application is submitted. The binding price is the one displayed in the summary at the moment of submission.
- Prices are gross prices and cover the intermediation service and obtaining the visa code only.
- The consular fee for issuing the visa itself is not included — the Client pays it separately at the Iranian consulate or at the airport, according to the tariff in force at the place where the visa is collected.
- Payment is made by bank transfer to the account indicated in the Form (in Polish zloty or in euro). The Website does not act as a payment intermediary, uses no payment gateway and does not process payment card details. The QR code with the transfer details is generated inside the Client's browser.
- Processing of the application starts once the payment has been credited.
- An invoice is issued at the Client's request.
Performance and deadlines
- Normal mode — approximately 7 working days.
- Rapid mode — approximately 4 working days. In every case substantially shorter than normal mode.
These periods are based on the average processing time of earlier applications and are indicative only — they are not a binding deadline. How long processing takes is decided by the Iranian visa authority, whose conduct the Provider cannot influence.
Recommended time for submitting the application
To improve the chances of obtaining the visa code in time, we recommend submitting the application no later than:
- 14 working days before departure — for normal mode,
- 7 working days before departure — for rapid mode.
The recommendations above concern obtaining the visa code only and do not include the time needed for the consulate to issue the visa. Collecting the visa is a separate step and the Client is responsible for it.
Submitting the application later increases the risk that the visa code will not be issued before the planned departure. That risk is borne by the Client. The Provider is not liable for the consequences of late submission, in particular for the need to change travel dates or for the costs involved.
The earliest possible entry date
The processing times given above are a necessary minimum, not a declaration. The form will therefore not accept an application if fewer than the following remain before the planned entry date:
- 9 calendar days — for normal mode (7 working days + 2 non-working days),
- 6 calendar days — for rapid mode (4 working days + 2 non-working days).
Where fewer than 9 but at least 6 calendar days remain, only rapid mode is available — the form will indicate that the mode has to be changed. Below 6 days no application can be submitted in any mode: processing physically cannot finish before the planned entry.
Once the visa code has been obtained, the Provider sends it without delay to the e-mail address given in the Form, together with information on what to do next at the place of collection.
Guarantee: a visa code or your money back
If the Iranian visa authority refuses to issue the visa code, we refund the whole fee for the service of obtaining it. The refund is made within 14 days of the day we learn of the refusal — to the account the payment came from. You do not have to ask for it or prove anything.
The decision to grant or refuse the code is taken solely by the Iranian visa authority and the Provider has no influence over it. The guarantee means that in the event of a refusal you do not pay for the service — we return the entire amount we received from you.
Scope of the guarantee
The guarantee covers only the refund of the fee charged for our intermediation — the one we received
from the Client.
It does not cover:
- consular fees
- transport costs
- accommodation
- insurance
- bookings
- or any other expenses incurred by the Client in connection with the planned trip.
For that reason we recommend refraining from buying non-refundable tickets and accommodation until the visa code has been obtained.
Conditions for the guarantee to apply
The guarantee applies if the Client:
- gave true and complete data matching the passport,
- supplied a photograph and passport scan meeting the requirements — including after any request to correct them,
- answered the questions asked while the case was being handled.
When the guarantee does not apply
No refund is due where the refusal results from circumstances on the Client's side:
- works in an occupation carrying a raised risk of refusal. The Iranian visa authority looks more closely at applications from people connected with the military and uniformed services (soldier, police officer), the media (journalist, reporter), scientists and researchers (in chemistry and physics) and politicians. Holding such an occupation does not mean that the visa code will not be issued — it means a higher risk of refusal. The form recognises these occupations automatically and shows a warning;
- has previously breached the rules in force in Iran — committed an offence, overstayed the permitted period, was deported or is subject to an entry ban;
- gave untrue data or concealed circumstances material to the examination of the application;
- the refusal occurred solely for reasons on their side.
The guarantee concerns a refusal to issue the visa code (the authorisation) only and does not cover the time of its issue. If the code is issued later than the indicative periods given under Performance and deadlines — the service is deemed performed and no refund is due.
If the Provider has not filed the application for reasons on its own side, the Client receives a full refund regardless of the above conditions.
Scope of the Provider's liability
The points below do not limit the money-back guarantee described above — they only set out what belongs to the Provider and what to the Iranian authority. The subject of the contract is preparing and filing the application with due care.
The Provider is not liable for:
- the decision of the Iranian visa authority to refuse the visa code. A refusal is not improper performance of the contract by the Provider
- decisions of border services, including refusal of entry despite a valid visa code. At that stage the service has already been performed, so the guarantee does not apply.
- the time taken to process the application. The periods given under Performance and deadlines — both the indicative ones and the recommended minimums — are for information only. They are not a binding deadline, they do not constitute an obligation of the Provider, and exceeding them does not amount to improper performance of the contract.
- costs incurred by the Client with other providers — tickets, accommodation, insurance and bookings.
What the Provider is liable for:
For non-performance or improper performance of its own obligation —
for example, had it failed to file the application at all, or filed it with an error of its own
(Art. 471 of the Polish Civil Code).
- Towards a Consumer — on general terms, for the normal consequences of such a failure (Art. 361 § 1 of the Civil Code).
- Towards a Client who is not a Consumer — up to the amount of the fee paid for the service. That limitation does not apply to damage caused intentionally.
Right of withdrawal
A Consumer who has concluded a distance contract may withdraw from it within 14 days without giving a reason (Art. 27 of the Polish Act of 30 May 2014 on consumer rights). The period runs from the day the contract is concluded. It is enough to send a statement before that period expires to wiza@gazeleziranu.com.
The service takes less than 14 days and begins as soon as the payment is credited, so the right of withdrawal works differently here than when buying goods. We set it out below for three separate moments.
Before the payment is credited
We have not started work yet. Withdrawal involves no costs at all, and any amount paid — if it has already arrived — is returned in full.
After the application is filed with the Iranian visa authority
By submitting the Form and making the payment, the Client expressly requests that performance begin before the withdrawal period expires (Art. 15(3) of the Act on consumer rights) and confirms this by a separate statement in the Form. From that moment we prepare the application and file it with the Iranian visa authority.
Filing the application exhausts the substance of the service. The subject of the contract is preparing and filing the application, not waiting for the outcome — and the latter cannot be undone or recalled. Withdrawal after that moment remains formally possible, but under Art. 35 of the Act on consumer rights the Client pays for what has been performed up to the moment of withdrawal, in proportion to its scope. As that scope is complete at that point, the amount due equals the full price of the service and no refund is available.
After the case is closed
Once the visa code has been passed on, or the final decision of the Iranian visa authority delivered, the service is fully performed and the right of withdrawal expires — Art. 38(1)(1) of the Act on consumer rights. That provision requires the Consumer's express and prior consent and information that the right will be lost once the service is performed; the statement made in the Form satisfies both.
A refusal of the visa code is an entirely different situation from cancelling. The rules above apply only where it is the Client who changes their mind. If, on the other hand, the Iranian authority refuses to issue the code — we refund the fee in full, whatever stage the case had reached.
Complaints
- A complaint may be submitted by e-mail to wiza@gazeleziranu.com or in writing to the Provider's address.
- A complaint should include: your name, the e-mail address given in the application, the case number (if one has been assigned), a description of the objections and how you would like the matter resolved.
- The Provider examines the complaint and replies within 14 days of receiving it, to the e-mail address from which it was sent. Failure to reply within that period means the complaint is upheld.
- Where the information provided is not sufficient to examine the matter, the Provider asks for it to be supplemented; the period then runs from the day it is supplemented.
Prohibition on unlawful content
The Client is prohibited from supplying content of an unlawful nature (Art. 8(3)(2)(b) of the Act on the provision of services by electronic means). In particular, it is forbidden to:
- provide untrue data, or another person's data without authorisation,
- send forged or altered documents, or documents not belonging to the Client,
- send files containing malicious software,
- take actions that disrupt the Website, including automated submission of applications.
The Provider may refuse to process an application or withdraw from the contract with immediate effect upon finding a breach of this prohibition. Sending a forged document may constitute a criminal offence and be reported to the competent authorities.
Personal data
The rules for processing personal data — including the scope of data collected, retention periods, the transfer of data to Iran and the Client's rights — are set out in the Privacy policy, which supplements these terms.
Submitting an application requires separate, explicit consent to the transfer of data to Iran — a country for which the European Commission has not issued an adequacy decision (Art. 49(1)(a) GDPR). Without that consent the service cannot be performed.
Out-of-court dispute resolution
A Consumer may use out-of-court means of handling complaints and pursuing claims, in particular by:
- seeking free assistance from a district (municipal) consumer ombudsman,
- applying to the regional inspector of the Trade Inspection to open mediation proceedings or to have the case heard by a permanent arbitration court,
- using advice from consumer organisations, including the Consumer Federation (Federacja Konsumentów).
Detailed information is published by the Polish Office of Competition and Consumer Protection: uokik.gov.pl. Using these means is voluntary and requires the agreement of both parties.
Changes to these terms
The Provider may amend these terms for important reasons — changes in the law, in the scope of services, in payment methods or in the requirements of the Iranian visa authorities. An amendment does not affect contracts concluded before it takes effect: an application is governed by the terms in force on the day it was submitted.
The current version and its effective date are shown at the top of this page. Matters not covered here are governed by Polish law, in particular the Civil Code, the Act on the provision of services by electronic means and the Act on consumer rights. The choice of Polish law does not deprive a Consumer of the protection afforded by the mandatory provisions of the law of their country of habitual residence.
